Dean James MacPherson summarizes the themes and offers analysis on RCAP77, RCAP78, and RCAP79, all of which deal with Aboriginal Justice issues in Canada. Following his report are closing comments and a closing prayer which ends the Commission's sitting.

File contains an opening prayer from the sitting of the Royal Commission on Aboriginal Peoples at Fort St. John, B.C. November 20, 1992, followed by a presentation by Sergeant Randy Munroe of the Ft. St. John Royal Canadian Mounted Police detachment. Munroe's presentation gives information on the Aboriginal alternate sentencing and supervision programs being piloted in the community. Following his presentation the assembled Commissioners ask him a variety of questions about these programs.

File contains a presentation by Mr. Andrew Boase, Hopedale RCMP. Boase discusses problems with the RCMP in Hopedale, Labrador. Following the presentation Commissioners Dussault and Sillet discuss policing issues with Boase and previous presenter Toby Andersen.

The file contains a presentation by Cece McCauley. McCauley comments on Aboriginal staffing issues with the Inuvik RCMP; as well as job training and government employment generally in Northern Communities. Following McCauley's comments is a general discussion between Commissioners John Holman and preceding presenter George Gillies on Inuvik hospital maintenance costs. After the discussion Commissioner Rene Dussault thanks the days' participants, discuses tommorows session, and closes the days' sitting of the Royal Commission. Joan-Cole Heine concludes the days' sitting with a closing prayer.

Following the presentation is a discussion between Chief Flett and Commissioners Blakeney and Chartrand regarding the issues raised in the presentation.

These include federally: "Creating Choices, the Task Force on Federally Sentenced Women"; "A Law Refrom Commission Report on Aboriginal People and Criminal Justice"; and, "The Indian Policing Task Force" provincially: "The Marshall Inquiry"; "The Manitoba Justice Inquiry"; "The Saskatchewan Indian and Metis Justice Review Committees"; and "The Alberta Causy (PH) Commission".

This file contains a portion of Volume 2 of a sitting of the Royal Commission on Aboriginal Peoples at Akwesasne Mohawk School, Cornwall Island, Ontario. This portion of the Volume includes a presentation given by Ontario Provincial Police Inspector Ernie Houghton and Chief of Police Brian David, on the subject of the Akwesasne court system. As well as questions from the assembled Commissioners to this presentation and those made previously.

McGregor discusses policing within the community and the initiatives that have been taken, as well as juridictional and cultural issues. This file contains a presentation by five members of the Mohawk Council of Kahnawake. Subjects discussed by the presenters include arrests of Kahnawake residents in 1988 relating to cigarettes; the Oka Crisis of 1990; negotiations relating to self-government; the removal of the Indian Act; transfer payments to Aboriginal persons; education and housing issues, and the Kahnawake Peacekeepers (police force). A question-and-answer session with the Commissioners follows the presentation.

He discusses the nature of the justice system in Canada, the cultural diversity of Aboriginal peoples, and the problems with the term "system," the history of European legal systems relationship with Aboriginal justice, and discusses various models used in the United States, Australia, Canada, and closes by stating that "it is not a question of a unified system or of separate Aboriginal systems...It is a matter of recognizing existing authority and human rights."

This file contains a presentation in French by the Committee to Promote and Monitor Human Rights in Kahnawake and the Neighboring Communities relating to the 1990 Oka Crisis and the current joint SQ-RCMP patrols from Kahnawake territory. A question-and-answer session with the Commissioners follows the presentation.

After welcoming the Commission to her community, Andersen discusses some of their concerns such as a lack of adequate community funding, water and sewer system problems, poor roads, fishery issues, policing, housing, and the need for land development.

This file contains a presentation by Mark LaForme relating to his experiences in negotiations with First Nations, Ontario and the federal governments in the area of self-government. He refers to not the overall governance of a community, but with specific matters such as policing agreements for First Nations, and joint stewardship of resources immediately adjacent to First Nations communities. The First Nations negotiations that LaForme has been involved with look for practical, realistic solutions to problems that face Aboriginal people every day.

File contains a presentation made by the Muskrat Dam First Nation. Chief Frank Beardy, Juliette Duncan, Sarah Beardy, Victoria Beardy, Shirley Morris, Lucy Beardy and Mary-Ann Morris all spoke to various topics of welfare, medical services, education, general health. Also contained are questions and comments from the assembled Commissioners.

File contains a presentation by Pastor Stanley Reid, of the Crime Prevention Committee. Reid discusses the lack of policing in coastal communities, and the problem of a lack of resources generally to deal with crime and crime related issues.

File contains a presentation by Peter Nakogee. Nakogee gives a demographic overview of the community of Moosonee, and discusses the composition of the Moosonee Development Board (a system of local governance) of which he is a part. Commissioner Erasmus discusses this governance model with him following the presentation.

File contains a summary of the preceding round table discussion on the Oka Crisis of 1990, and related issues of Aboriginal Non-Aboriginal relations in the Oka area by Pierre Trudel, rapporteur. Trudel highlights a variety of themes in the discussion by Non-Aboriginal people which shows the difference in perception of the root causes of the Oka crisis between the Mohawk and Quebecois populations. This portion of the Commission includes a presentation by the School of Human Justice given by Jim Harding concerning the Justice System as it pertains to the Aboriginal Community. Questions from the assembled commissioners are also present.

File contains a presentation by Simeon Tshakapesh, Youth Council and Tribal Police. Tshakapesh discusses the lack of control Innu youth feel over their own lives as the root of many of the serious social problems plaguing Davis Inlet. Tshakapesh stresses the need for community based education, treatment programs, and support groups. He discusses the rights of youth, need for recreational facilities, relocation to a new and better village site, funding, community policing, language and culture issues.

File contains a presentation by Steven Katz. Katz discusses justice issues in Canada, and the need for an overhaul of the system due to systemic discrimination toward Aboriginal peoples. Following the presentation Katz discusses some of these concerns with Commissioners Chartrand and Sillet.

The file contains a presentation by Superintendent Brian Krambl, City of Winnipeg Police Department. Krambl discusses the Police services efforts to date regarding employment equity, cultural education, and general policing issues. Following the presentation Commissioners Chartrand and Wilson discuss some of the issues raised with Krambl.

File contains presentations by Winona Diabo and Joyce K. Mitchell of the Kanawahke Court System. Diabo describes how her community has had its own court system functioning for twelve years without government funding. She outlines a list of priorities and requests for assistance from the Commission, as well as giving an overview of how the justice system functions at Kanawahke with respect to both policing and judicial processes.

File contains a presentation by Tony Mandamin. Mandamin (a lawyer) discusses the legal system in Canada and Aboriginal societies' interactions with it. Mandamin highlights associated issues such as Aboriginal over-representation in the penal system, and a lack of cultural appropriateness in legal proceedings. Following the presentation is a discussion between Mandamin and Commissioners Blakeney and Chartrand on some of these issues.

File contains a presentation by Tony Murdoch and Con Graham of the Battlefords Adult Diversion Project. Murdoch delivers a presentation describing the project which exists to reconcile non-dangerous adult offenders with their victims under the direction of a mediator. Murdoch describes the program and its success, as well as the ethnic makeup of the participants (roughly 50% Non-Aboriginal and 50% Aboriginal). Following the presentation Murdoch discusses the program and its particulars with Commissioners Blakeney and Erasmus.

This file consists of a presentation by Wally McKay focusing on policing by First Nations men and women on reserves. McKay describes traditional Aboriginal policing models being based on peacemaking and peacekeeping.

File contains a presentation by the St. Basil First Nation, Floyd Bernard on behalf of Chief Richard Wallace. Bernard discusses many of the problems of his small community, mainly a lack of adequate infrastructure and service (such as Police and Fire services) provisions. File also contains a conversation between Erasmus and Bernard on these issues, as well as the purpose of the Royal Commission.

Roch and Gagne discuss the viewpoints of their organization which represents municipal police across Quebec, with the exception of Montreal. They deliver a presentation on policing Aboriginal people and Aboriginal communities, the need for increased understanding of Aboriginal cultural and legal issues, and related matters related to law enforcement. Following the presentation is a discussion between the representatives and the assembled Commissioners on law enforcement issues.

File contains a presentation regarding Women's Issues by Millie Nelson. Nelson, a member of the Roseau River Women's Group since 1975, discusses child welfare, prostitution, and family violence issues. Following the presentation the assembled Commissioners discuss the issues raised with Nelson.

File contains a presentation by Chief Thomas Bressette of the London District Chiefs. Bressette, Chief of the Chippewas of Kettle and Stony Point First Nation, London District, discusses his peoples land dispute with the Department of National Defence over an area known as Stony Point. Chief Bressette goes on to discuss land and self-governance issues generally, recommending to the Commissioon that an arbitration board be set up to resolve such disputes similar to the practice employed in labour relations, and that the federal Department of Indian Affairs be dismantled.

File contains an open round table discussion on Aboriginal justice issues in Canada with 34 participants. The theme of the discussion is whether the existing justice system can be remodelled to fit the needs of Aboriginal peoples, and examining the development of culturally appropriate dispute resolution mechanisms. Following the discussion is a closing prayer (pg. 548).
